Protection of the couple’s affairs, including de facto affairs

In addition to allowing married or civilly united couples to plan the management of their assets and succession-related matters—including those connected to the possible legal termination of the relationship (i.e. unified management of assets in favor of all Beneficiaries after the relationship ends, including ex-spouses; payment by the Trustee of maintenance for the person designated as a ‘dependent’ through the Trust’s income; protection of assets from the influence of new spouses/partners)—the Trust also offers protection for long-term couples who choose not to legally formalize their relationship.

It represents a valid alternative to the current civil law framework, which is at times lacking in regard to vulnerable individuals, allowing assets to be allocated in favor of a person unable to manage them independently, so that the benefits derived are used exclusively in the interest of the vulnerable person.

Planning the couple’s financial future: the Trust allows for the protection and safeguarding of partners without a formal marriage bond by regulating the property regime of the relationship, thereby clarifying both partners’ intentions regarding asset management and future distribution—whether in the event of separation or death—based on the couple’s dynamics and expectations, and avoiding future disputes.
Protecting the surviving partner’s inheritance rights: in the absence of marriage, one partner may have no rights over the other’s assets in the event of death. The Trust ensures that the surviving partner receives the benefits that were agreed upon, avoiding succession issues that could otherwise completely exclude the surviving partner.
Fulfilling self-caring goals: in the event of incapacity of one partner, the Trust ensures that the assets are managed by a designated Trustee in favor of both individuals, preventing financial matters from becoming a burden for the other partner or their children, if any, and allowing them the time and space to care for the ill or vulnerable individual.
